Terms and Conditions

1. The Agreement

This agreement consists of these Terms and Conditions of Sale, the information provided during the order process, and any specific terms agreed upon between you and us. In the event of any inconsistency, the specifically agreed terms will take precedence — provided they do not conflict with applicable Australian consumer law.

This agreement is also supplemented by the relevant provisions of the Australian Consumer Law (ACL), which governs the sale of goods between businesses and consumers in Australia.

The Buyer is the consumer who places an order on the website, referred to as “you” or “the customer.”


3. Price

All prices displayed on our website are shown in Australian dollars (AUD) and include GST and all applicable charges.
No additional costs will apply unless clearly stated prior to checkout.


4. Formation of the Contract

A binding agreement is formed once the customer has placed an order and the order has been accepted by the seller.

However, the agreement will not be considered binding if there is an obvious typographical or pricing error on the website or in the order confirmation that the other party knew or should reasonably have known was a mistake.


5. Payment

Payment can be made using the methods displayed at checkout. We may charge your selected payment method when your order is confirmed or when it is dispatched.

For card payments, the purchase amount may be pre-authorised when you place your order. The card will be charged once the goods are shipped.

For customers under the age of 18, post-payment options (such as invoice or delayed payment) are not available.


6. Delivery

Delivery is complete when the customer, or their authorised representative, has received the goods.

Unless otherwise stated during checkout, orders are dispatched from our Australian warehouse and generally delivered within 2–5 business days.
We work with reliable carriers such as Australia Post, CouriersPlease, Aramex, and Sendle.

If no delivery time is specified, we will deliver your order as soon as reasonably possible — no later than 30 days from the date of purchase.


7. Risk

The risk of loss or damage to the goods passes to the customer once the goods have been delivered in accordance with these terms.


8. Right to Cancel (Change of Mind)

In addition to your rights under Australian Consumer Law, we offer a 90-day money-back guarantee for all Vivita products.
You may return your product within 90 days of receipt for a full refund, provided it is in its original condition and packaging.

To exercise this right, please contact our customer service team by email or via our contact form within 90 days of receiving your product.

Customers are responsible for the direct cost of returning items unless otherwise agreed. Refunds are processed within 14 business days of receiving the returned product.


9. Delays or Non-Delivery

If we do not deliver the goods within the agreed timeframe, and the delay is not caused by the customer, you may:

  • Withhold payment until delivery is made,

  • Request that the order be fulfilled, or

  • Cancel the order and request a full refund.

If you wish to cancel the order due to delay, please contact us in writing (email is acceptable).


10. Faulty or Defective Goods

If a product you receive is faulty, not as described, or fails to meet acceptable quality standards, you are entitled to a remedy under the Australian Consumer Law.

Depending on the circumstances, this may include a repair, replacement, or refund.
You must notify us of any fault within a reasonable time after discovering it.

Please contact our support team with your order number, proof of purchase, and photos or video (if applicable) to help us resolve your claim quickly.


11. Seller’s Rights in the Event of Breach

If the customer fails to pay for the goods or otherwise breaches the agreement, and this is not caused by the seller, we may:

  • Withhold delivery,

  • Cancel the order, and/or

  • Seek reasonable compensation for costs incurred.

Late payments may incur interest or recovery fees as permitted under Australian law.


12. Warranty

All Vivita products come with a 2-year quality guarantee in addition to your statutory rights under the Australian Consumer Law.
Our warranty provides extra peace of mind and does not limit your legal rights to a refund or replacement for faulty goods.


13. Privacy and Personal Information

The seller is responsible for the processing of personal information collected in connection with purchases.
We collect only the personal data necessary to fulfil your order, deliver your goods, and communicate with you.

Your data will never be shared with third parties except where required to complete your purchase or by law.

14. Dispute Resolution

If you have a complaint, please contact us first via kontakt@vivitanordic.com so we can resolve the issue directly.

If a resolution cannot be reached, disputes will be governed by Australian law, and you may contact your local consumer protection agency or the Australian Competition & Consumer Commission (ACCC) for guidance.
